It is increasingly common for whole or part of a property to be transferred between family and friends. This can be expensive and confusing if not handled correctly, and exemptions and benefits could be overlooked if the transaction is not managed with an experienced and expert conveyancer.
For example, did you know that in some circumstances the transfer of property between husband and wife can be exempt from stamp duty?
Aurora Conveyancing has had years of experience in these matters and below is simply a brief outline of how we would conduct the transfer once you and the other parties have agreed on a price for the transfer.
- Preparation of the transfer document;
- Research and advise you if stamp duty is payable and if so, how much;
- Prompt you to arrange payment of stamp duty;
- Attend to stamping the document and providing it to both parties to sign and return to our office;
- Contact the lender acting for the purchaser and the lender acting for the seller to advise them and provide documentation;
- Assist the purchaser to sign mortgage documents and satisfy the banks requirements;
- Order searches of council, water and land tax rates so that the parties can adjust these amounts;
- Prepare settlement figures (including adjustments) for both parties approval;
- Arrange settlement with the lenders and request any cheques/ documents that either party may need to produce;
- Attend settlement and notify you afterwards.
